These Terms and Conditions (the "Terms") govern your use of the SmileQuest website at www.smilequestvn.com and the planning, coordination, and concierge services we offer to international patients travelling to Vietnam for dental treatment. By accessing the website, sending us an enquiry, or booking a package, you agree to these Terms.
Please read them carefully. If you do not agree with any part of them, please do not use our website or services.
1. Who we are
SmileQuest is a dental-trip planning and concierge service operated by the founders Judy and Richard, based in Ho Chi Minh City, Vietnam. References to "we," "us," "our," and "SmileQuest" in these Terms mean the SmileQuest business.

2. What we are and what we are not
SmileQuest is a planning, coordination, and concierge service. We help you select a dental clinic, arrange transfers, accommodation, support, and optional tours, and stay reachable before, during, and after your trip.
We are not a dental clinic. We do not perform dental procedures, prescribe medication, or provide medical advice. All dental treatment is performed by independent, licensed clinics in Vietnam ("Partner Clinics"). The clinical relationship — including consent, treatment, billing for treatment, complications, and warranty — is between you and the Partner Clinic.
SmileQuest does not provide medical, dental, legal, tax, or financial advice through the website, social media, video content, or messages. Any information we share is for general guidance only.
3. Eligibility
To use our services you must:
- Be at least eighteen (18) years old, or have the consent of a parent or legal guardian.
- Have the legal capacity to enter into a binding contract.
- Provide accurate and complete information about yourself and any companion you book for.
- Be eligible to travel to Vietnam under your country's laws and Vietnam's entry requirements.
If you are booking on behalf of another person (such as a parent, spouse, or child), you confirm that you have their permission to share their information with us and to book the package for them.
4. Enquiries, quotes, and bookings
When you complete the form on www.smilequestvn.com, message us on WhatsApp, or email us, we will respond with information about our packages and, where you share dental photos or quotes, a preliminary suggestion of the right package.
Quotes are estimates only until confirmed in writing. The Partner Clinic's in-person assessment is the only definitive treatment plan, and final treatment cost may change once the dentist examines you in person.
A booking is confirmed only when:
- You have selected a package (Refresh, Renew, or Transform, or another offering we agree on).
- You have provided the information we need to plan the trip.
- You have paid the deposit (see Section 5).
- We have sent you a written booking confirmation.
5. Pricing, payment, and currency
Package prices are published on www.smilequestvn.com in US dollars and cover the inclusions listed for that package. They do not include the cost of dental treatment unless explicitly stated. Treatment is billed by the Partner Clinic directly to you.
Deposit and balance: a deposit (amount confirmed in your booking) is required to secure your trip. The balance is due on the date set out in your booking confirmation, typically before arrival.
Payment methods: we accept the payment methods listed in your booking confirmation. Bank fees, currency-conversion charges, and any third-party processing fees are your responsibility.
Taxes and duties: you are responsible for any taxes, duties, or other charges that apply to you in your country of residence in connection with your booking.
6. Cancellations, changes, and refunds
Because we book third-party services (clinics, hotels, transport, tours) on your behalf, the deposit and parts of your package may be non-refundable once those bookings are confirmed.
Cancellations by you: if you cancel after paying the deposit, refunds (if any) follow the schedule set out in your booking confirmation. We will always do our best to recover refundable amounts from third-party providers on your behalf.
Changes by you: we will try to accommodate changes (dates, hotel, package upgrade, additional companions). Changes may incur extra costs from third-party providers, which you will be told about in writing before they are applied.
Cancellations or changes by us: if we have to cancel or significantly change your booking for reasons within our control (for example, a Partner Clinic becoming unavailable), we will offer you a comparable alternative or a refund of the SmileQuest-managed amounts you have paid for the affected portion of the trip.
Force majeure: we are not liable for failure to perform our services due to events outside our reasonable control, including but not limited to natural disasters, pandemics, government action, civil unrest, strikes, transport failures, or border closures. In these cases we will work with you in good faith to reschedule or to recover refundable amounts.
7. Travel documents, insurance, and health
You are solely responsible for:
- Holding a valid passport and obtaining any visa, e-visa, or visa waiver required to enter and leave Vietnam.
- Booking your international flights to and from Vietnam (unless explicitly included in your package).
- Arranging travel insurance covering medical care, trip interruption, lost baggage, and any other risks you wish to insure.
- Telling us about pre-existing medical conditions, allergies, medications, and any other health information relevant to dental treatment.
- Following the Partner Clinic's pre- and post-treatment instructions.
8. Dental treatment, clinical risk, and complications
All dental procedures carry some clinical risk. By booking through SmileQuest you understand and accept that:
- The Partner Clinic, not SmileQuest, is responsible for the clinical assessment, the treatment plan, the treatment itself, post-treatment instructions, and any warranty offered on the work.
- The final treatment plan and cost are determined by the dentist in person and may differ from the preliminary plan or quote.
- Outcomes vary between patients. We do not guarantee a specific aesthetic, functional, or longevity result.
- Complications may occur during or after treatment. The Partner Clinic is responsible for diagnosing and addressing clinical complications under their warranty and applicable law.
- If a complication appears after you return home, you should contact your local dentist for emergency care, then contact us so we can liaise with the Partner Clinic about follow-up under their warranty.
9. Conduct during the trip
To make sure every patient has a safe and enjoyable trip we ask that you:
- Treat our team, Partner Clinic staff, hotel staff, drivers, and other patients with respect.
- Follow all clinic instructions, hotel rules, and applicable Vietnamese laws.
- Do not use illegal drugs while travelling with SmileQuest.
- Drink alcohol only in moderation and not in a way that interferes with your treatment or care.
We reserve the right to refuse, suspend, or terminate service to anyone who behaves abusively, threatens our team or others, or breaks the law. In those cases no refund will be due.
10. Use of the website
You agree to use www.smilequestvn.com only for lawful purposes and in a way that does not infringe the rights of, or restrict the use of, the website by anyone else. You agree not to:
- Use the website to send spam or any unsolicited or unauthorised commercial communication.
- Attempt to gain unauthorised access to any part of the site, the server it runs on, or any connected database.
- Introduce viruses, trojans, worms, or other malicious code.
- Scrape or copy substantial parts of the site for commercial use without our prior written consent.
11. Intellectual property
All content on www.smilequestvn.com — including text, photos, videos, logos, illustrations, design, layout, and software — is owned by SmileQuest or our licensors and is protected by copyright and other intellectual-property laws.
You may view, download for personal use, and print individual pages for your own non-commercial reference. You may not republish, sell, license, or commercially exploit any of our content without our prior written consent.
12. User-generated content
If you send us photos, videos, written reviews, social-media posts about SmileQuest, or other content, you grant SmileQuest a worldwide, non-exclusive, royalty-free licence to use, reproduce, and display that content for marketing and operational purposes. You confirm that the content is your own, does not infringe anyone else's rights, and that you have the consent of any other people who appear in it.
Before-and-after photos of your treatment will not be used in marketing without your explicit written consent.
13. Third-party services and links
Hotels, drivers, restaurants, tour operators, payment processors, insurers, and Partner Clinics referenced on the website or used during your trip are independent businesses. Their own terms, privacy policies, and warranties apply to the services they provide directly to you. SmileQuest is not liable for the acts or omissions of these third parties beyond what is required by applicable law.
14. Limitation of liability
Nothing in these Terms limits any liability that cannot be limited by law, including liability for death or personal injury caused by negligence, fraud, or fraudulent misrepresentation.
Subject to the paragraph above:
- SmileQuest's total aggregate liability to you in connection with our services and the website is limited to the total amount you have paid SmileQuest for the package giving rise to the claim.
- SmileQuest is not liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, loss of business, loss of data, or loss of opportunity.
- SmileQuest is not liable for clinical outcomes, complications, or warranty issues arising from treatment performed by Partner Clinics — those are the responsibility of the Partner Clinic under their own terms and applicable law.
15. Indemnity
You agree to indemnify and hold SmileQuest, its founders, employees, contractors, and partners harmless from any claim, loss, liability, or expense (including reasonable legal fees) arising from your breach of these Terms, your misuse of the website, your behaviour during the trip, or any false or misleading information you have given us.
16. Privacy
How we handle your personal information is described in our Privacy Policy, available on www.smilequestvn.com. By using our services you confirm you have read and understood the Privacy Policy.
17. Communications
By giving us your phone number, email, or WhatsApp, you agree that we may contact you about your enquiry, your booking, and your trip. You can opt out of marketing emails at any time by clicking the unsubscribe link or by replying to ask us to remove you. Service messages related to your trip will continue while your booking is live.
18. Modifications to these Terms
We may update these Terms from time to time. When we do, we will change the "Effective" date at the top of this document and post the updated version on www.smilequestvn.com. Continued use of the website or our services after a change takes effect means you accept the updated Terms.
19. Governing law and disputes
These Terms are governed by the laws of the Socialist Republic of Vietnam, without regard to its conflict-of-laws rules. We will always try to resolve any complaint informally first.
If a dispute cannot be resolved informally, you and SmileQuest agree to submit to the non-exclusive jurisdiction of the competent courts of Ho Chi Minh City, Vietnam. Consumers resident in Canada, the United Kingdom, the European Union, Australia, or New Zealand may also benefit from any mandatory consumer protections of their place of residence; nothing in these Terms removes those protections.
20. Severability and entire agreement
If any part of these Terms is held to be invalid or unenforceable, the rest will remain in force. These Terms, together with the Privacy Policy and your booking confirmation, form the entire agreement between you and SmileQuest regarding our services.
